01
Scope and acceptance
Creating an account, ordering, activating, using or renewing a service constitutes full acceptance of these terms, the specifications of the selected offer and, for domain names, the rules of the relevant registry. A customer ordering for an organisation warrants that they are authorised to bind it.
02
Orders, activation and availability
An order becomes final after payment validation and technical or administrative acceptance by CleanDev and, where applicable, by the supplier or registry. A domain availability search is indicative; only registry confirmation grants a right of use. CleanDev may request supporting documents and refuse or suspend an irregular, apparently fraudulent or technically impossible order.
03
Prices, payment and account top-ups
Applicable prices, currencies, terms and taxes are those displayed at checkout. Payment is due before activation or renewal. Fees already committed to a registry or supplier and consumed account credit are non-refundable, except where mandatory law applies or an error is directly attributable to CleanDev.
Amounts paid for Professional Email and Advanced DNS services are non-refundable once activated, including where the customer cancels, stops using the service or requests termination before the end of the purchased term. Cancellation prevents future renewal but creates no right to a full or partial refund, subject to mandatory law.
04
Domain names: fair choice and third-party rights
The customer alone selects the domain name and must verify before ordering that it is lawful, fair and available and does not infringe any third-party right, including a trademark, trade name, company name, personal name, copyright or other intellectual property right.
Cybersquatting, typosquatting, impersonation, customer diversion, phishing and any misleading, unfair, abusive or bad-faith registration are prohibited. A domain grants a time-limited right of use, not ownership. The customer accepts ANTIC policies for “.cm” and applicable ICANN and registry policies.
06
Hosted content and prohibited uses
The customer is solely responsible for all content, data, software, messages and activity connected with the services. The customer must comply with Cameroonian law and the applicable laws of every country in which the content is accessible, offered, targeted or produces effects.
Prohibited uses include child sexual abuse material or glorification of crime, terrorism or violence; fraud, scams, phishing, spam, malware, hacking or attacks on systems; infringement of intellectual property, privacy or personal data; unlawful defamation, hatred or discrimination; prohibited trade, games, products or services; and any content or use contrary to law, an authority’s decision or a third party’s rights.
Professional Email mailboxes and the email-sending features included with cPanel are intended for ordinary professional correspondence. They must not be used for newsletters, bulk campaigns, unsolicited messages or spam, or for scam, fraud, impersonation or phishing messages. Any lawful, consent-based newsletter campaign must use a dedicated bulk-email platform. CleanDev may immediately block sending or suspend the service to protect recipients, IP addresses and the reputation of its infrastructure.
07
Security, resources and backups
The customer must protect credentials, keep applications updated, remain within plan resource limits and maintain regular external backups. Any backup performed by CleanDev is an operational measure and does not replace the customer’s own backup; its availability or restoration is not guaranteed.
08
Expiry and renewal: customer vigilance
The expiry date is a firm deadline. A delay of even one day is sufficient for the service to become expired and may lead to suspension or deletion under the conditions shown in the customer area. The customer alone must monitor this date and pay for renewal before expiry. Email, SMS and other reminders are a courtesy. Failure to send or receive them for any reason — incorrect details, spam filtering, outage or other incident — does not extend the deadline or release the customer from this duty.
Automatic renewal occurs only when enabled, sufficient credit is available and the registry or supplier accepts the operation. The customer must verify that renewal has actually completed.
09
Suspension, grace periods and permanent deletion
A service may be suspended immediately on expiry. Details of any grace, redemption or restoration period applicable to the service are stated in the customer area. Such a period is a technical or commercial tolerance, not an extension of the service term or an acquired right. Where the expired service is still maintained or technically restorable, restoration or reactivation fees shown in the account may apply in addition to the renewal price. Payment does not constitute restoration until CleanDev, the supplier or the registry has effectively confirmed it.
Once the applicable period has elapsed, CleanDev, its supplier or the registry may permanently delete the service. If a domain name has been deleted after expiry, to the fullest extent permitted by applicable law the customer has no right to claim anything in respect of that domain and may not demand its continued operation, recovery, restoration, recreation, reassignment, refund, compensation or damages, even where the deadline or applicable period was exceeded by only one day. The domain may become available and be assigned to a third party.
For hosting or any service containing data, deletion may permanently remove files, databases, email, configurations and backups. The customer must export data before expiry and, after deletion, may not demand its retention, recovery or restoration, except for rights that cannot legally be waived.
10
Suspension for abuse or risk
CleanDev may, with or without prior notice depending on urgency, limit, isolate, suspend or terminate a service in the event of non-payment, unverifiable details, a credible complaint, a security risk, abnormal resource use, unlawful or unfair use, breach of these terms, breach of registry policy or a request from a competent authority. Measures necessary to protect the network may be taken immediately.
11
Availability and liability
CleanDev provides the services with reasonable care but does not warrant uninterrupted availability. Interruptions may result from maintenance, incidents, attacks, networks, registries, suppliers or force majeure. To the extent permitted by law, CleanDev is not liable for indirect loss, loss of revenue, reputation or data, or consequences of customer or third-party fault. Direct liability is limited to amounts paid for the affected service during the twelve months preceding the event.
12
Termination and refunds
The customer may request termination; it does not cancel amounts already due and takes effect no later than the current expiry date. A domain request submitted to the registry is normally irreversible and non-refundable. No pro-rata refund is due after hosting activation, except under an expressly advertised commercial guarantee, non-performance attributable to CleanDev or mandatory law.
13
Personal data and communications
Customer data is used to manage the account, provide, secure and bill services, meet legal obligations and send operational information. It may be provided to registries, technical suppliers, payment providers or authorities where necessary. The customer agrees to receive communications required for performance and security of the services.
14
Evidence, changes and severability
Technical logs, electronic validations, orders, payments and emails retained by CleanDev are admissible evidence unless rebutted. These terms may change to reflect law, technology or registry policy. The version accepted at order or renewal applies. If one clause is invalid, the remaining clauses continue in effect.
15
Governing law and disputes
These terms are governed by Cameroonian law without depriving consumers of mandatory protections. Complaints must first be sent to support for an amicable resolution. Failing agreement, the competent courts are determined by applicable procedural law. Domain disputes also remain subject to relevant registry procedures, including ANTIC procedures for “.cm” and ICANN procedures where applicable.
